Waste & Storm Water

Drainage of surface flows is an integral part of any canal system. In addition to the right of ways TFCC enjoys for such purposes, most farms have drainage easements over the farm below which have been established by grant or by custom for the discharge of waste or stormwater. The filing of the TFCC System Plats in the early 1900s gave the upgradient farms (dominant estate) a drainage easement onto the down gradient farms (servient estate). As a long observed rule of thumb, the upper owner was required to main the drainage ditch (or facility) to avoid flooding the lower owner to the point on the ditch where the waste or surface flows was diverted by the lower owner or by TFCC if the water is recaptured for redelivery in the TFCC Canal System.
